ACA Urgent Update: New Model Cobra Notices: A New General Notice and a Common Sense Change to the Cobra Election Notice!

The Department of Labor has released three updated Notices: Cobra General Notice, Cobra Election Notice and CHIP Model Notice.
At last we have a new General Notice to go with last year’s updated Election Notice. The purpose of the new notices is to clarify the availability of coverage through the Health Insurance Marketplace (Exchange) and provide information on special enrollment rights for such coverage.
And someone realized that the OMB Paperwork Reduction Notice contained in last year’s new Cobra Election Notice expanded the Election Notice by a full page, when printed. These updated notices eliminate that contradiction.
The Children’s Health Insurance Notice has been updated as well. This notice must be provided to all employees before the start of a new Plan Year. Typically, Superior Benefit Plans clients receive this at Open Enrollment.
On Wednesday, we will review the May 2 HHS Memo, creating a(nother) Special Enrollment Right in healthcare.gov: for the next 60 days “through July 1 2014” Cobra beneficiaries, both eligible and enrollees can enroll in the Federally Facilitated Exchange (FFM) by phoning Healthcare.gov. without waiting for the next open enrollment period or for the Cobra benefits to be exhausted.
