In a 6-3 Decision, The Supreme Court of the United States (SCOTUS) decides in King v. Burwell that insurance subsidies will continue to be available in all Insurance Marketplaces regardless of whether or not the State choose to setup their own Exchange or a Federal one. The court determined that “an Exchange established by the State under [42 U.S.C. Section 18031]” is ambiguous which means it can be interpreted to apply to both State and Federal Marketplaces, rejecting the petitioners view of plain-meaning. This ruling goes in the favor of the Obama Administration and once again SCOTUS upholds key provisions of the Affordable Care Act (ACA).
